Terms of Service

1. Acceptance of Terms

By accessing or using ImageLayer's website, API, widget, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

ImageLayer provides an AI-powered branded image generation platform. The Service includes:

  • An embeddable widget for generating branded images within your applications
  • A REST API for programmatic image generation
  • A dashboard for managing brand kits, API keys, and usage
  • Brand customization tools (logos, palettes, typography, style guidelines)

3. Account Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and API keys. You agree to notify us immediately of any unauthorized access.

You must be at least 18 years old or have the legal authority to enter into these Terms on behalf of your organization.

4. Plans and Credits

The Service operates on a credit-based system. Each image generation request consumes credits according to your plan. Details on plan limits, pricing, and credit usage are available on our Pricing page.

Unused monthly credits do not roll over unless specified by your plan. Additional credit packs may be purchased separately and do not expire.

5. Acceptable Use

You agree not to use the Service to:

  • Generate illegal, harmful, or abusive content
  • Create content that infringes on intellectual property rights of others
  • Produce deceptive or misleading imagery (deepfakes, impersonation)
  • Circumvent usage limits or abuse API rate limiting
  • Reverse-engineer, decompile, or disassemble the Service
  • Resell access to the Service without written authorization

We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

Your Content

You retain ownership of the prompts you submit, brand assets you upload, and the images generated using the Service. We do not claim ownership over your content.

License to Us

You grant us a limited, non-exclusive license to process your content solely to provide the Service (e.g., applying brand assets to generated images, caching for delivery).

Our Property

The Service, including its design, code, documentation, and branding, is owned by ImageLayer and protected by applicable intellectual property laws.

7. API and Widget Usage

API keys are confidential. You must not expose API keys in client-side code. Session tokens should be generated server-side and provided to the widget. We may impose rate limits to ensure fair usage and service stability.

8. Payment Terms

Paid plans are billed in advance on a monthly or annual basis. Payments are processed by Lemon Squeezy (Merchant of Record). All fees are non-refundable except where required by law. We may change pricing with 30 days' written notice.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for losses caused by downtime.

10. Limitation of Liability

To the maximum extent permitted by law, ImageLayer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

Either party may terminate these Terms at any time. You can close your account from the Dashboard settings. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days to allow for data export, after which it will be deleted.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Continued use after changes constitutes acceptance.
